These Terms of Use ("Terms") form a binding agreement between you and Avrelion ("Avrelion," "we," "us," or "our") governing your access to and use of avrelion.com (the "Site"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
These Terms govern use of the Site only. Any penetration testing, digital forensics, or other professional services we perform are governed by a separate, signed engagement agreement or statement of work, which takes precedence over these Terms for the scope of that engagement.
1. Eligibility
The Site is intended for business and professional use. By using the Site, you represent that you are at least 16 years old and have the authority to agree to these Terms on your own behalf or on behalf of an organization you represent.
2. Permitted Use
- You may access and use the Site for lawful purposes related to learning about, evaluating, or engaging Avrelion's services.
- You may not use the Site to probe, scan, or test the vulnerability of any Avrelion system, or attempt to breach any security or authentication measures, except with prior written authorization under a signed engagement agreement.
- You may not use the Site to transmit malware, conduct unauthorized data harvesting or scraping, interfere with the Site's normal operation, or impersonate any person or entity.
- You may not reproduce, duplicate, copy, sell, or exploit any portion of the Site without our prior written consent.
3. Intellectual Property
All content on the Site — including text, graphics, logos, the Avrelion name and mark, and the underlying design and code — is owned by Avrelion or its licensors and is protected by applicable intellectual property laws. No rights are granted to you other than the limited right to view the Site for its intended purpose.
4. Third-Party Links
The Site may contain links to third-party websites or services that are not owned or controlled by Avrelion. We are not responsible for the content, privacy practices, or terms of any third-party sites. Accessing linked sites is at your own risk.
5. No Professional Advice
Content on the Site is provided for general informational purposes only and does not constitute security, legal, or professional advice. Any security testing, findings, or recommendations are only valid in the context of a scoped, authorized engagement conducted under a separate agreement.
6. Disclaimers
The Site is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any defects will be corrected.
7. Limitation of Liability
To the fullest extent permitted by applicable law, Avrelion and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of, or inability to use, the Site, even if advised of the possibility of such damages. Our total aggregate liability arising out of or relating to the Site will not exceed one hundred U.S. dollars (US $100).
8. Indemnification
You agree to indemnify and hold Avrelion harmless from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the Site.
9. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Avrelion is established, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Site will be subject to the exclusive jurisdiction of the courts located in that jurisdiction, unless otherwise required by applicable mandatory law.
10. Changes to These Terms
We may update these Terms from time to time to reflect changes to the Site or our practices. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
11. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
